The trial begins Monday in Denver. Mueller actually went legal first, in 2015, suing the musician for defamation after he lost his job on a local radio station two days after meeting her. In Swift's testimony, her team said she'll argue that she had no reason to accuse Mueller of sexual assault if it didn't occur, as she didn't know him before the incident and didn't have any motive to try and terminate his employment. According to USA Today, Mueller's attorney will be raising the question of mistaken identity as well as claiming that Swift only filed a lawsuit when David Mueller filed on in 2015.
In court filings, Mueller denied he groped Swift and "has testified unequivocally that 'I am sure that I did not'". He's seeking unspecified damages. The case has been approved for trial despite the fact that it has been four years since the alleged sexual assault.
Taylor Swift will not be the only person testifying in the courts as she has asked some witnesses, and friends, to testify on her behalf in the trial. Court documents say it is unlikely that either side will settle. The pair met Swift during a backstage meet and greet.
One month later, Swift countersued Mueller for assault and battery.
"Right as the moment came for us to pose for the photo, he took his hand and put it up my dress and grabbed onto my ass cheek, and no matter how much I scooted over, it was still there", Swift said in her deposition.

Entertainment news outlet TMZ obtained and published the photo, which has since been sealed by the court.
Mueller's boss said the DJ told him during an internal investigation that any contact during the photo op was incidental or accidental.
